1. Acceptance of Terms

By accessing or using Fexyn VPN (“Fexyn,” “the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and Fexyn.

2. Service Description

Fexyn provides a Virtual Private Network (VPN) service that encrypts your internet connection and routes it through secure servers. The Service includes:

• Encrypted internet connectivity via multiple protocols (WireGuard, XRay VLESS, OpenVPN)
• Access to VPN servers across multiple geographic locations
• Desktop and mobile client applications
• Account management and device management tools

3. Account Registration

• You must provide accurate and complete information when creating an account.
• Each person may maintain only one account. Duplicate accounts may be terminated.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You must be at least 16 years of age to create an account and use the Service.

4. Subscription & Billing

• Subscriptions are billed on a recurring basis (monthly, quarterly, or annually) through Stripe.
• Prices are displayed in USD and include applicable taxes where required.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• New accounts receive a trial period with full VPN access. After the trial ends, a paid subscription is required to continue using the Service. Trial duration may vary by plan.
• We offer a 30-day money-back guarantee on all paid plans. If you are unsatisfied within the first 30 days of your paid subscription, contact support for a full refund. The guarantee does not apply to renewals.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.

5. Acceptable Use

You agree to use the Service responsibly:

• Do not use the Service for any illegal activity.
• Do not abuse the network by generating excessive traffic intended to disrupt service.
• Do not share your account credentials with others or allow unauthorized access.
• Do not resell, redistribute, or sublicense the Service without written permission.
• Respect device limits associated with your subscription plan.

6. Prohibited Activities

The following activities are strictly prohibited:

• Unauthorized access to computer systems or networks (hacking)
• Sending unsolicited bulk messages (spam)
• Distribution of malware, viruses, or other harmful software
• Copyright infringement or piracy
• Harassment, stalking, or threats against individuals
• Exploitation of minors in any form
• Any activity that violates applicable local, national, or international law

Violation of these terms may result in immediate account termination without refund.

7. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee:

• 100% uptime or uninterrupted service
• Specific connection speeds or latency
• Availability of specific server locations at all times
• Compatibility with all networks, ISPs, or geographic locations

Scheduled maintenance windows will be communicated in advance when possible. We may modify, suspend, or discontinue any aspect of the Service at any time.

8. Intellectual Property

The Fexyn name, logo, branding, website content, and client applications are the property of Fexyn and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without explicit written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Fexyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

• You may cancel your account at any time through the Settings page or by contacting support.
• We may suspend or terminate accounts that violate these Terms, with or without notice.
• Upon termination, your access to the Service ceases immediately, and your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through a notice on our website at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
